Please read these Terms of Use carefully before using the Fotki application. By downloading, installing, or using the app, you agree to be bound by these terms.



1. About the Service


Fotki ("the App") is an AI-powered photo restoration service that enhances, repairs, and upscales old or damaged photographs. The App is provided by:

2. Eligibility


You must be at least 13 years of age to use the App. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian.



3. No Account Required


The App does not require registration or a personal account. Instead, a randomly generated device identifier is created and stored locally on your device the first time you launch the App. This identifier is used solely to manage your coin balance on our servers.



4. Coin System


  • New users receive a free starter balance of coins upon first launch, enough to try the service.
  • Each restoration uses 1 to 3 coins depending on the selected quality mode.
  • Coins are non-refundable once a restoration has been successfully completed.
  • If a restoration fails due to a server error, coins spent on that attempt are automatically refunded.
  • Additional coins may be purchased through in-app purchases (subject to the terms of Apple App Store or Google Play).


    • 5. Your Content


    You retain all rights to the photographs you submit for restoration. By submitting a photo, you grant us a limited, temporary license to process it through our AI pipeline solely for the purpose of generating a restored version for you.


    You represent and warrant that:

  • You own or have the legal right to use any photo you submit.
  • The photo does not contain content that is illegal, harmful, or violates the rights of any third party.
  • You will not use the App to process photos of minors in a manner that is inappropriate or harmful.


    • 6. Prohibited Uses


    You agree not to use the App to:

  • Process photos you do not have the right to use.
  • Attempt to deceive, defraud, or harm other people using restored photos.
  • Reverse-engineer, decompile, or disassemble any portion of the App.
  • Use automated tools, bots, or scripts to interact with the service.
  • Circumvent coin limits or attempt to manipulate the coin balance system.
  • Violate any applicable laws or regulations.

    • Prohibited content. You must not upload, submit, or attempt to generate any content that:

  • Depicts minors in a sexual, exploitative, or harmful manner. Such content is strictly prohibited and will be reported to the appropriate authorities.
  • Contains or promotes violence, torture, or graphic gore.
  • Is pornographic, sexually explicit, or obscene.
  • Promotes hatred, discrimination, or violence against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  • Constitutes harassment, threats, or intimidation of any person.
  • Depicts or encourages illegal activity, including but not limited to drug use, terrorism, or trafficking.
  • Infringes the copyright, trademark, or other intellectual property rights of any third party.
  • Contains personal data of third parties without their explicit consent.

    • We reserve the right to terminate your access immediately and without notice if we detect or suspect any violation of these prohibitions.



    7. AI Processing and Quality


    Restorations are performed by AI technology and results may vary. We do not guarantee:

  • Any specific level of quality or accuracy in the restored output.
  • That the restored photo will match your expectations or the original intent.

    • Variability of results. AI models interpret images algorithmically and may produce results that differ from what you anticipated. Factors such as the degree of damage, image resolution, lighting conditions, and the complexity of the original photo all affect the outcome. A restoration that works well for one photo may produce a different result for another, even under similar conditions. This is inherent to how generative AI works and is not a malfunction of the App.


    If you are not fully satisfied with a result, you may try a different restoration mode (Quick Save, Details, or Full Restore), as each applies a different level of processing that may better suit your photo.


    The App is provided for personal, non-commercial use. We are not responsible for how restored images are used after they are saved to your device.



    8. Intellectual Property


    The App, including its design, code, branding, and all content created by us, is the exclusive property of the developer and is protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the App without our prior written consent.


    Restored images produced from your original photos belong to you. We claim no ownership over your photos or the AI-generated restorations.



    9. Third-Party Services and Image Data Processing


    The App uses the following third-party services to deliver its functionality:


  • Runware — AI image processing API. Photos you submit are transmitted to Runware's servers solely for the purpose of performing the restoration. Runware's own terms of service and privacy policy apply to their handling of this data.

    • How your image data is used. When you submit a photo for restoration, the image is securely transmitted to Runware's API for AI processing. This transmission is strictly limited to what is necessary to produce the restored result. Your photos are:

  • Not stored on our servers beyond what is technically required to complete the request.
  • Not published, shared, or made accessible to any third party other than Runware for processing purposes.
  • Not used to train AI models by us.
  • Not sold or transferred for any commercial or marketing purpose.

    • Your consent. By submitting a photo for restoration, you acknowledge and agree that the image will be transmitted to Runware's API for AI processing as described above. If you do not agree to this, please do not use the restoration feature.


    We are not responsible for the practices or content of third-party services. We encourage you to review Runware's privacy policy at their official website.



    10. In-App Purchases


    If you purchase coins through the App:

  • All purchases are final and non-refundable, except where required by applicable law.
  • Purchases are processed by Apple App Store or Google Play and are subject to their respective terms.
  • We are not responsible for failed purchases or billing disputes — please contact Apple or Google directly for refunds.


    • 11. Disclaimer of Warranties


    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


    We do not warrant that:

  • The App will be uninterrupted, error-free, or secure.
  • Any defects or errors will be corrected.
  • The App or its servers are free of viruses or harmful components.


    • 12. Limitation of Liability


    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


    Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid us in the 30 days preceding the claim.



    13. Termination


    We reserve the right to restrict or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or are using the App in a manner that is harmful to us or other users.



    14. Changes to These Terms


    We may update these Terms from time to time. Material changes will be communicated via an update notice in the App or on our website. Continued use of the App after changes become effective constitutes acceptance of the new Terms.



    15. Governing Law


    These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the App will be subject to the exclusive jurisdiction of the competent courts.
